The Kakadu Website is created and controlled by NSi as such, the laws of the Australia will govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of laws. We reserve the right to make changes to our site and these disclaimers, terms and conditions at any time.

Entire Agreement

These Terms of Service, Copyright statement, Privacy Statement and Disclaimer constitutes the entire agreement between the parties hereto pertaining your use of the Kakadu Site, and any and all written (except to the extent a software license agreement signed by you and NSi governs your use of the Kakadu Site) or oral agreements heretofore existing between the parties hereto are expressly canceled.  If for any reason a court of competent jurisdiction finds any provision of this policy, or any portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to affect the intent of the policy, and the remainder of this policy shall continue in full force and effect.  

In any action to enforce this agreement, the prevailing party will be entitled to costs and legal fees.  In the event that any of the provisions of this agreement are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this agreement shall otherwise remain in full force and effect. 

Changes to this Agreement

NSi reserves the right to change this agreement at any time, so we encourage you to review this web page periodically.  The changes will be effective immediately when published on the Kakadu Site.  Your use or continued use of the Kakadu Site following the posting of any changes to this agreement shall constitute your acceptance of the changed agreement.  If you do not accept this policy, you may not use the Kakadu Site.
